This Privacy Statement (this "Privacy Statement") explains how information about, and/or that directly identifies, you or makes you identifiable ("personal information") is collected, used and disclosed by Sales and Marketing Heuristics, LLC dba Vessel ("Vessel," "we" or "us") in connection with our website at https://vesselscale.com (the "Site"), our mobile or tablet-based applications ("Apps"), and productivity application services offered in connection with the Site (collectively, with the Site and the Apps, the "Services") and how you can exercise your privacy rights.

What Does Vessel Do?

Vessel augments US manufacturers with operational expertise and supply chain resources via a network of public and private entities that is designed to help buyers and suppliers of manufacturing services, and those that support them – collectively referred to as our “Network” – build better relationships and work more efficiently together. As a veteran-owned business with a missing to re-shore American manufacturing, we are committed to your privacy and to the security of your data.
What Does this Privacy Statement Cover?

This Privacy Statement applies to all the products, services and websites offered by Vessel and explains how we use your personal information when we use your personal information for our own purposes, in our capacity as a data controller.

In the event our users are subject to our Terms of Service or other services agreement to use the Services, we act as a processor of the personal information that is provided to Vessel via use of the Services, and we contractually commit ourselves to process such information on behalf and under the instruction of the applicable user, who is the data controller. This Privacy Statement does not apply to such processing and we recommend you read the Privacy Statement of the applicable user, if their processing concerns your personal information.

In all other cases, we are the controller of your personal information, including information we process in connection with your use of the Services. This Privacy Statement describes how we process your personal information in such cases.
Information We Collect, and How We Collect It

We collect personal information in connection with your visits to and use of the Services. This collection includes information that you provide in connection with the Services, information we obtain from third parties, and information that is collected automatically such as through the use of cookies and other technologies.

Contact form submissions. When you respond to a “Contact Us” page, we collect your email address and whatever other information you provide to us.

Registration information. We collect personal and/or business information that you provide when you register for an account to use the Services. We may also collect such information when you register for certain events, such as webinars, video and other informational sessions, talks, etc. This information may include your name, email address, and password. In some circumstances, such as where you are an employee of a customer, we may also collect business related information about you, such as your job title, company name and business contact details.

Publicly available company information. When using our hosted services for MEPs, Manufacturers, Buyers, Suppliers, and third parties (collectively, the “Services”), you may provide Vessel with data, information or content regarding you, your company, capabilities, products, services, offerings, or procurement requirements (“User Content”) including, without limitation, when creating or claiming a profile or otherwise listing your business, capabilities or offerings on the Site for access, use and evaluation by potential clients, customers or buyers (collectively, “Buyers”) or for access, use or evaluation by potential vendors or suppliers (collectively, “Suppliers”). When you create a profile or claim a profile on the Site, you control what information is added to, removed from, or modified in that profile.

Information collected through the use of the Services. After registration, you may create, upload or transmit files, documents, data or information as part of your use of the Services (collectively, "User Content"). User Content and any information contained in the User Content, including personal information you may have included, is stored and collected as part of the Services. You have full control of the information included in the User Content.

Usage data. We may collect usage data about you whenever you interact with our services. This may include the webpages you visit, what you click on, when you performed those actions, and so on. Additionally, like most websites today, our web servers keep log files that record data each time a device accesses those servers. The log files contain data about the nature of each access, including originating IP addresses.

When you create, share or export User Content from the Services with third party services, we may receive information such as user names, IP addresses, device identifiers, profile information, contacts, or e-mail addresses. When you integrate the Services with third party services, we may receive information such as user names, IP addresses, device identifiers, profile information, contacts, or e-mail addresses. We also may receive any other information that a third party site or service shares with us (or that you choose to allow it to share with us). The data we receive may depend upon your privacy settings with the site or service, though we do not control those settings or promise they will be effective. The technologies used by Google and other third-party analytics tool providers may collect information such as your IP address, time of visit, whether you are a returning visitor, and any referring website. The technologies used by Google Analytics do not gather information that personally identifies you. The information generated by Google Analytics will be transmitted to and stored by Google and will be subject to Google's privacy policies. Third parties and online advertising. We may share, or we may permit third-party online advertising networks, social media companies and other third-party services, to collect information about you, your computer or device when you visit or use the Services, open emails and otherwise interact with us. These third-party online advertising networks, social media companies, and other third-party services collect information about your use of our Site over time so that they may play or display ads, on other devices you may use, and on other websites, apps, or services. With Whom We Share or Disclose User Information.

​We also share, transmit, disclose, grant access to, make available, and provide personal information with and to third parties, including to:

Provision to our Community. We provide, display, publish and make User Content available to our Network including potential Customers and/or Suppliers that use our site and services to connect to potential customers, clients, vendors, and suppliers. This is done primarily to help connect Buyers and Suppliers and assist Suppliers listed on our site in connecting with potential Buyers in existing and new markets and industries. Information within your profile may be shared with the rest of our Network except for your contact email and phone number, which are shared only with your MEP center and your connections.

Manufacturing Support Organizations: Vessel partners with local Manufacturing Extension Partnership (“MEP”) centers in many states and other manufacturing support organizations and may share information from supplier profiles, including User Content, with those partners for the purposes of manufacturing industry research. This sharing is limited to company name, address, and capabilities - as well as aggregated and anonymized usage data. We do not share any personal information about any manufacturers' supply chain or supply chain activity.

Your Suppliers: The vendors you add to your Connections and Lists within your profile are strictly confidential. We do not share information about the vendors you manage with other Community members or any external individuals or organizations. Your Notes and other Supplier Management activities within your profile are completely confidential as well.

Your Projects: We do not share the details about your Projects, the vendors you invite to participate in your Projects, or the disposition of those Projects with other Community members or outside agencies. All messages and shared files exchanged within a Project are strictly private between you and your vendors. If you list a Community Project, only the project details will be listed and for only other registered Community members to see.

Your Files and Messages: We do not have access to the files you upload and share. You control who you share files with and you may revoke privileges or remove files you’ve shared with others at your discretion. The contents of all your messages are strictly private; even our team at Vessel cannot access them.

Our Service Providers: In some cases, we also share your information with our service providers who help us to provide our services to you. This may include payment processors or similar vendors that may handle information not intended for public dissemination on our site or in connection with our services. In these cases, we contractually bind these service providers to keep your information confidential and to use it only for the purpose of providing their services to us. For example, we use payment processors who help us to process credit card transactions. By using our services, you authorize Vessel to sub-contract in this manner on your behalf. Rare circumstances include when we need to share information if required by law, or in a corporate restructuring or acquisition context (see below for more details). Ways we may share your information include the following:

Aggregated information to third parties to improve or promote our services. We do not share information about how you use our applications or features or how often you use them. From time to time, we may use aggregated, de-identified activity information to measure and improve performance or to develop new features, but this data will not be attributable to you. No individuals can be identified or linked to any part of the information we share with third parties to improve or promote our services.

Your information if required or permitted by law. We may disclose your information as required or permitted by law, or when we believe that disclosure is necessary to protect our rights, and/or to comply with a judicial proceeding, court order, subpoena, or other legal process served on us.

Your information if there’s a change in business ownership or structure. If ownership of all or substantially all of our business changes, or we undertake a corporate reorganization (including a merger or consolidation) or any other action or transfer between Vessel entities, you expressly consent to Vessel transferring your information to the new owner or successor entity so that we can continue providing our services. If required, Vessel will notify the applicable data protection agency in each jurisdiction of such a transfer in accordance with the notification procedures under applicable data protection laws.
