ARTIFICIAL INTELLIGENCE ADDENDUM TO VESSEL TERMS OF SERVICE

This Artificial Intelligence Addendum ("Addendum") is part of and incorporated into the Terms of Service ("Agreement") between you and Sales & Marketing Heuristics, DBA Vessel ("Vessel", "we", "us", or "our") governing your use of the Vessel Platform and related Services. This Addendum specifically pertains to the use of Artificial Intelligence ("AI") functionalities within the Vessel Platform. By using the AI functionalities, you agree to the terms of this Addendum.

 

1. AI Functionality: The Vessel Platform may include AI functionalities and tools designed to assist in providing predictive insights, automated tasks, content generation, and decision-making support ("AI Services"). These AI Services may evolve over time based on user interaction, data input, and machine learning algorithms.

2. Use of AI Services:

   • You agree to use the AI Services in compliance with the Agreement and this Addendum.

   • You are responsible for the inputs you provide to the AI Services and the interpretation of any outputs or results generated.

   • You acknowledge that AI Services are provided "as is" and "as available," and Vessel does not guarantee the accuracy, reliability, completeness, or appropriateness of any data, information, or recommendations provided by the AI Services.

3. Data and Privacy:

   • In connection with the AI Services, you may provide Vessel with data, content, or information ("User Data"). You grant Vessel a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, modify, and display the User Data solely for the purpose of providing and improving the AI Services.

   • Vessel will maintain appropriate administrative, physical, and technical safeguards for the protection of the security, confidentiality, and integrity of User Data.

   • The processing of personal data, if any, will be done in accordance with the Privacy Policy of Vessel and applicable data protection laws.

4. Intellectual Property:

   • Vessel retains all rights, title, and interest in and to the AI Services, including any improvements, modifications, or enhancements made thereto, notwithstanding any use of User Data in connection with the AI Services.

   • You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas or algorithms of the AI Services.

5. Limitations and Disclaimers:

   • The AI Services are not intended to be used as a substitute for professional advice. You are solely responsible for ensuring that your use of the AI Services is in compliance with applicable laws and regulations and Vessel’s Terms of Service.

   • Vessel disclaims all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement regarding the AI Services.

   • Vessel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the AI Services.

6. Changes to the Addendum:

   • Vessel reserves the right to modify this Addendum at any time. You agree to review the Addendum periodically to be aware of such modifications. Your continued use of the AI Services after any such modifications shall constitute your consent to such changes.

7. Termination:

• The terms of this Addendum shall continue to apply until terminated by either you or Vessel as set out in the Agreement.

By using the AI functionalities within the Vessel Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Addendum.
